Upon the request of the Agency, the Basic Court fined KEDS for negligence in safety of Processing Data

By the decision of the Basic Court and recommendation by the NAPPD, the Kosovo Company responsible for Distribution and Supply with Electricity – KEDS, is fined in the amount of €9,000.00, for  negligence in taking legal measures for the safety during processing data of the citizens. After the Agency gave some opinions of advisory nature to KEDS, who continued delivering electricity bills of the consumers without applying the standard of closed envelopes, an standard through which would be fulfilled the safety criteria for protection of personal data of the citizens, the NAPPD was forced to refer the case to the competent court, in accordance with the legal provisions, due to permission granted by the party-KEDS, for unauthorized access in reading of personal data, since electricity bills containing personal information were delivered to consumers unclosed in envelopes, leaving the bills everywhere in the  premises where they live, giving an opportunity to third parties to have unauthorized access in the electricity bills, action which is in contradiction with the requests and provisions of the Law on Protection of Personal Data.
It is worth mentioning that the Agency, so far has been concentrated, in raising awareness of the violators of the provisions of the Law on Protection of Personal Data, through the application of soft measures - by addressing advisory recommendations. However, the persistent complaints for violations of the privacy of citizens, through exposure of their data even to third parties and failure to take measures for securing personal data processed by the controller, in this case KEDS, its issue was handed to the Basic Court of Prishtina, which by a decision, fined the KEDS in an amount of €9,000.00 for disrespecting the legal provisions of the above mentioned.
