Subject rights

You have the right to be informed at any time when a controller processes your data, whether that data was obtained from you or even in those cases where it was not obtained from you. Exercise the right to information.

You have the right to access your data every time the controller confirms that it is processing your personal data. Exercise the right of access to your data.

You have the right to ask the controller to correct your personal data if they are inaccurate and incomplete. Exercise the right to correction.

You have the right to ask the controller to delete your personal data, if one of the conditions provided by the LTMP applies. Exercise the right to delete (‘right to be forgotten’).

You have the right to request from the controller the restriction of the processing of personal data if one of the conditions provided by the LMDP is applied. Exercise the right of restraint.

When you request from the controller the right to correct, delete or restrict personal data, he is obliged to communicate this with any recipient to whom the personal data has been declared.

You have the right to receive your personal data which you provided to the controller in connection with you, in a certain format, and you have the right to transmit this data to another controller. Exercise the right to transfer data.

You have the right to object to the processing of personal data relating to you, due to a particular personal situation, if the processing applies to Article 5, paragraph 1, subparagraphs 1.5 and 1.6. You also have the right to object if the processing is done for the purposes of fair marketing. Exercise the right to object.

You have the right not to be subject to a decision based solely on automatic processing, including profiling that produces effects on you or affects you in a similar way.

All these rights such as the right to information, the right to access data, the right to correction, the right to restriction, the right to delete, the right to restrict, the right to transfer, the right to object may are limited if such a restriction respects the essence of fundamental rights and freedoms and is a necessary and proportionate measure to guarantee certain situations as defined in Article 22 of the LPDHP.

If you think that your rights guaranteed by the Personal Data Protection Law have been violated, you have the right to file a complaint (with the possibility of clicking that at the time of clicking the complaint box opens) at the Agency.

If you have suffered material or immaterial damage as a result of the violation of the LTMP, you have the right to compensation from the controller or processor for the damage suffered, by filing a lawsuit with the competent court.
